1. General
These terms and conditions apply to all services provided by NorthseaFinance B.V., located in Amsterdam, Netherlands (Chamber of Commerce: 82345678, AFM license: 12345678).
2. Definitions
- Service Provider: NorthseaFinance B.V.
- Client: Natural person using our services
- Services: All financial services such as investment advice and portfolio management
- Platform: Our online website and applications
3. Applicability
These terms apply to all agreements between NorthseaFinance and clients. Deviating terms are only valid if agreed in writing.
4. Service provision
4.1 Investment services
We provide investment services under supervision of the AFM. All services are provided in accordance with the Financial Supervision Act (Wft).
4.2 Suitability assessment
For providing investment advice, we conduct a suitability assessment in accordance with MiFID II regulations.
5. Risks
Investing involves risks. The value of your investments can fluctuate. We explicitly point out the following risks:
- Price risk: Value changes in investments
- Credit risk: Default of counterparties
- Liquidity risk: Possible inability to sell
- Market risk: General market movements
- Technology risk: Specific to crypto investments
6. Costs and fees
All costs are communicated transparently in accordance with AFM guidelines. A complete overview can be found in our cost overview.
7. Client obligations
The client undertakes to:
- Provide accurate and complete information
- Timely payment of amounts due
- Compliance with platform rules and conditions
- Report changes in personal circumstances
8. Intellectual property
All intellectual property rights to the platform and content belong to NorthseaFinance or our licensors.
9. Liability
Our liability is limited to the amount paid out under our professional liability insurance, with a maximum of €2,500,000 per event.
10. Privacy and data protection
For the processing of personal data, we refer to our privacy policy, which forms part of these terms.
11. Complaints
Complaints can be submitted to:
- Our internal complaints committee
- The Financial Services Complaints Institute (KiFiD)
- The Netherlands Authority for the Financial Markets (AFM)
12. Termination
The agreement can be terminated by both parties subject to a notice period of 1 month.
13. Applicable law
Dutch law applies to this agreement. Disputes will be submitted to the competent court in Amsterdam.
